Rule One: The Delta-8 Injunction

Practically, this means ingestible Delta-8 products (tinctures, gummies) remain available while the case is pending.

Rule Two: No Smokable Flower

Separately from the Delta-8 litigation, a rule effective March 31, 2026 bans smokable hemp products, calculated on a total-THC basis that pulls THCA into the equation — meaning high-THCA hemp flower, regardless of its Delta-9 percentage, is banned in smokable form in Texas.
